Terms & Conditions

Activities Participation Statement

It is the responsibility of the individual to inform the Club Committee, Club Captain, Coach, Trip Organiser or Activity Leader of any relevant medical condition or previous injuries the University of Strathclyde Sports Union should be aware of which may affect your or others safe participation in the activities of the Club.

By becoming a member of a Club you agree to adhere to and abide by the guidelines for participation as laid out by the Club as well as those laid out by the USSU.

You may be participating in activities that may involve an above average element of risk, in an environment where professional medical care and rescue services may not always be immediately available. In view of this it is your responsibility to ensure that you fully understand the exact nature of each activity you undertake, the risks involved and the equipment needed for your safe participation.

You should never participate in an activity where you are unsure of any of the above aspects. If in doubt, ask any of your Club Committee members or the USSU President for further information. It is also your responsibility to notify your next of kin of your desire to participate, before engaging in that activity.

 

Terms & Conditions of Membership
  1. Interpretation

In these terms:

  • USSU means the University of Strathclyde Sports Union, constituent group of the University of Strathclyde Students’ Association, located at 51 Richmon Street, Glasgow, G1 1XU
  • Member means the person named on/ associated with relevant Individual Membership;
  • Contract means the contract between the Member and USSU relating to the Member’s use of the Services;
  • Membership Sign-Up means the USSU Membership webpage(s) to which these terms are appended;
  • Membership Fee means the relevant membership fees advertised in all USSU published literature and on the USSU website relating to the Service from time to time;
  • Rules mean the rules and policies which apply to accessing and participating in the activities of USSU and its constituent Sports Clubs;
  • Services means the involvement by the member in the activities and services facilitated by USSU and its constituent Sports Clubs and supported by the University;
  • University means the University of Strathclyde, located at 16 Richmond Street, Glasgow, G1 1XQ.

The headings in these terms are for convenience only and shall not affect their interpretation.

 

  1. Supply of the Service

2.1 USSU and its constituent Sports Clubs shall provide the activities and services to the Member subject to these Terms.

2.2 USSU may correct any typographical or other errors or omissions in any brochure, promotional literature, quotation or other document relating to the provision of the Services without any liability to the Member.

2.3 USSU may at any time without notifying the Member make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services, or which in the opinion of USSU are reasonably necessary to protect the interests of USSU.

2.4 The Member shall comply with the Rules.

 

  1. Charges

3.1 The Member shall pay the appropriate Sports Union Membership Fee from time to time for the provision of the Services when the Membership Sign-Up is completed and submitted to USSU. The Member shall in addition pay from time to time such charges and penalties as specified by USSU where/ when necessary.

3.2 All fees quoted to the Member for the provision of the Services are inclusive of any value added tax.

 

  1. Warranties & Liability

4.1 USSU warrants to the Member that the Services will be provided using reasonable care and skill whilst acknowledging and discharging its Duty of Care.

4.2 USSU shall not be liable to the Member or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of USSU’s obligations in relation to the Services, if the delay or failure was due to any cause beyond USSU’s reasonable control.

4.3 The Member shall provide all information which is requested by USSU; without prejudice to clause 4.4 and to the other rights and liabilities of the Member and of USSU. USSU shall not be liable for any loss or damage suffered by the Member which is caused or contributed to by the failure to provide any such information.

4.4 Nothing in these terms and conditions is intended to exclude the liability of the USSU for death or personal injury caused by USSU’s negligence.

 

  1. Termination and Refunds

5.1 The Contract shall come into force on the date upon which the Membership Sign-Up, completed by the Member, is submitted to USSU. Subject to the following provisions of this clause, the Contract shall continue until the expiry of the membership category as stated when the membership is purchased.

5.2 If the Member is an officer or employee of, or student enrolled on a course of study at, the University, the Member may terminate the Contract if he ceases to be such an officer, employee or student. The Member may terminate the contract if he suffers an injury or other medical condition, which substantially affects his ability to use the Services. To terminate the Contract in accordance with this clause 5.2, the Member must give to USSU notice in writing of such termination, as set out in clause 6.2.

5.3. If the Contract comes into force otherwise than by the Member in person attending at the University with the completed and submitted Membership form, the Member shall have the right to terminate the Contract during the period of fourteen (14) days following the date on which the Contract was formed. To terminate the Contract in accordance with this clause 5.3, the Member must give to USSU notice in writing of such termination, as set out in clause 6.2.

5.4 Membership Fee refunds will be dealt with on a case-by-case basis between USSU and the Member. The eligibility period for such refunds is fourteen (14) days from the commencement date of the Contract. Refund applications should be directed to USSU by email or a written letter to the address given in clause 1.

5.5 USSU may terminate the Contract forthwith if the Member does not comply with the Rules.

5.6 Refunds will be issued subject to the conditions in stated in clauses 5.1, 5.2, 5.3, 5.4 and 5.5.

 

  1. General

6.1 These Terms (together with the terms, if any, set out in the Membership Sign-Up) constitute the entire agreement between the parties, supersede any previous agreement or understanding and may not be varied except in writing between the parties.

6.2 A notice required or permitted to be given in writing under these Terms shall be addressed to USSU at the address given in clause 1 of these terms and to the Member at the address given on the Membership Sign-Up or at such other address as may at the relevant time have been notified by the Member to USSU, and shall be delivered by hand or sent by pre-paid first class post, facsimile or electronic mail.

6.3 No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

6.4 If any provision of these Terms is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question shall not be affected.

6.5 Scottish law shall apply to the Contract, and the parties agree to submit to the nonexclusive jurisdiction of the Scottish courts.

6.6 USSU reserves the right to amend and change these Terms & Conditions, as it deems necessary in the best interests of USSU and the Member.

In purchasing a membership the Member is aware it is their responsibility to;

  1. Inform the Sports Club and/or Society’s committee/coach/trip organiser of any medical conditions or previous injuries that may affect my safe participation in the sport.
  2. Ensure that they fully understand the exact nature of each activity they will be undertaking, including the risks involved, skill levels required and the equipment needed for their safe participation.
  3. Not participate in any activity where they are unsure of any of the aspects mentioned in point 2.
  4. Notify their next of kin of their desire to take part in the sport before engaging in the activity.

By purchasing membership to USSU subsequently joining at least one of its constituent Sports Clubs, the Member agrees to read the relevant Sports Club Code of Practice and to act in accordance with this, the Sports Club Constitution and the following USSU Policies.

They also agree that any photographs / videos taken in relation to organised Sports Union activities may be used by USSU and/or the University of Strathclyde for promotional/ marketing purposes at their discretion.

Student Cards should be carried at all Sports Clubs events and individuals should be aware of their Student ID (matriculation) number.
